Adjustment of Status – Form I-485
Adjustment of Status is the process that allows certain individuals who are already in the United States to apply for lawful permanent resident status (a Green Card) without having to leave the country.
Form I-485, Application to Register Permanent Residence or Adjust Status, is filed with U.S. Citizenship and Immigration Services (USCIS). This application asks USCIS to review whether the applicant qualifies to become a permanent resident based on family-based, employment-based, humanitarian, or other eligible categories.
While the Form I-485 is pending, applicants may also be eligible to apply for employment authorization and advance parole, which allows international travel while the application is being processed.
Approval of Form I-485 results in the issuance of a Green Card, granting the applicant lawful permanent resident status in the United States.
Ajuste de Estatus – Formulario I-485
El Ajuste de Estatus es el proceso que permite a ciertas personas que ya se encuentran en los Estados Unidos solicitar la residencia permanente legal (Tarjeta Verde) sin tener que salir del país.
El Formulario I-485, Solicitud para Registrar Residencia Permanente o Ajustar Estatus, se presenta ante el Servicio de Ciudadanía e Inmigración de los Estados Unidos (USCIS). A través de esta solicitud, USCIS evalúa si el solicitante califica para convertirse en residente permanente según una categoría familiar, laboral, humanitaria u otra elegible.
Mientras el Formulario I-485 esté pendiente, el solicitante también puede ser elegible para solicitar autorización de empleo y permiso de viaje (Advance Parole).
La aprobación del Formulario I-485 resulta en la emisión de la Tarjeta Verde, otorgando estatus de residente permanente legal en los Estados Unidos.
